BUYER TERMS AND CONDITIONS

The following terms and conditions apply to all individuals , companies . or other

         legal entities which purchase Alpacas listed on our auction website.

1. By  registering to become a bidder / buyer :  buyer acknowledges that

Eastern Alpaca Marketing Group  ( EAMG ) makes no, and in fact

expressly disclaims any warranties as to the fitness of any alpaca (s)

listed for sale on its website  for a particular purpose , or health or condition

of any alpaca (s) for any particular purpose.

2. Buyer agrees to hold E.A.M.G. harmless and free from any liability for any

defects or problem in quality of alpaca(s) entered in the auction.

3. E.A.M.G.  is not a representative of either the Buyer or the Seller .  E.A.M.G.

makes no warranties or implied warranties to the fitness of any entry for a

particular purpose or of the merchantability.  Neither E.A.M.G. or their

administrators can give any warranties expressed or implied as to the quality

or description of the alpaca being listed for sale.  E.A.M.G. does not guarantee

the soundness of any alpaca or the birthing of any  female.

4. E.A.M.G. will not be held responsible for any discrepancies or errors and/ or

omissions and do not assume any liability on its part or the part of the Seller for

any written or verbal statements made regarding any alpaca (s) listed for sale.

5. Seller to be responsible for execution and delivery of all contracts between

buyer and seller.

6. In the event of any dispute between buyer and E.A.M.G., Buyer agrees E.A.M.G.

shall have the option to resolve such dispute through arbitration conducted at a

site chosen by E.A.M.G. located in the City of Richmond, Virginia or one of

its adjoining counties or in a court of appropriate jurisdiction located in

Henrico County , Virginia.

7. This Agreement shall be governed by and interpreted by the laws of the

Commonwealth of Virginia , regardless of the location where the Agreement may be  executed.

8. This Agreement will be binding on the heirs, assigns, and successors in interest of

the parties hereto.

9. By registering as a bidder / buyer the individual registering represents to

E.A.M.G. that he/she is over the age of eighteen years old or in the case of a corporation or other legal entity he/she/they are the authorized individuals(s) to execute this Agreement and further agree(s) to all the terms and conditions stated herein as buyer terms and conditions and all auction terms and conditions.

    10.   THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT 

              BETWEEN THE PARTIES AND CAN ONLY BE AMENDED BY

              WRITTEN  AMENDMENT SIGNED BY ALL PARTIES HERETO.) 

              THIS AGREEMENT  IMPOSES CERTAIN LEGAL OBLIGATIONS ON

              THE PARTIES HERETO; YOU HAVE THE RIGHT TO SEEK LEGAL

               COUNSEL PRIOR TO ENTERING INTO THIS AGREEMENT.
